LOL
How would a judge look at this? a verbal agreement and then sending someone money shows INTENT. Clearly there is no argument about where the money went, they both agreed it was to go to an apartment/condo. you send money and then not show up, its a loss! The only thing that he cant be held to is the actual lease because there is none, Not with Nate's signature anyway. Maybe Kelm is a shady bastard... I dont know, but this time he kinda got away with it.
You sir are also a complete dumb ***...
a "verbal Agreement" In any State does NOT hold up in court..
It would Become "Hearsay"
and you havn't been on here long enough to Know kelms history..
EVERY thread that someone has started about Kelm has been nothing
But Him screwing that person over...

ALWAYS valid, I went to JAIL for oweing someone $50 2 years ago, i agreeded to clean his car and **** came up... Sheriff Deputies arrested me I don't know what it's called but VERBAL agreeements are binding AS long as u have proof to see he entered into an agreement between him and me, something he's admitted to doing countless times and it says on comments in paypal for the money it's for deposit for the house. DEPOSIT.

Its amazing how many people have no clue what they are talking about. In terms of a VERBAL agreement, here is what Virgina Code Annotated section 11-2 says, and this is a direct copy and paste:
Unless a promise, contract, agreement, representation, assurance, or ratification, or some memorandum or note thereof, is in writing and signed by the party to be charged or his agent, no action shall be brought in any of the following cases:
1. To charge any person upon or by reason of a representation or assurance concerning the character, conduct, credit, ability, trade, or dealings of another, to the intent or purpose that such other may obtain thereby, credit, money, or goods;
2. To charge any person upon a promise made after attaining the age of majority, to pay a debt contracted during infancy, or upon a ratification after attaining the age of majority, of a promise or simple contract made during infancy;
3. To charge a personal representative upon a promise to answer any debt or damages out of his own estate;
4. To charge any person upon a promise to answer for the debt, default, or misdoings of another;
5. Upon any agreement made upon consideration of marriage;
6. Upon any contract for the sale of real estate, or for the lease thereof for more than a year;
7. Upon any agreement or contract for services to be performed in the sale of real estate by a party defined in § 54.1-2100 or § 54.1-2101;
8. Upon any agreement that is not to be performed within a year; or
9. Upon any agreement or promise to lend money or extend credit in an aggregate amount of $25,000 or more.
The consideration need not be set forth or expressed in the writing, and it may be proved (where a consideration is necessary) by other evidence.
I am not giving any legal advice, but there are many situations as cited above where a VERBAL agreement is NO GOOD

yah they take what they hear from random ppl or situations and call it gold lol. i actually research **** and have spent waaaaaaaaaaaayy too much time in courtrooms listening to ppl's cases as well as my own
but here lies the true issue. nates refund of deposit. kelm said hed give it, but in july when the lease is up. that can legally be upheld UNLESS... nate called kelm n told kelm in advance that he aint maken it n needs his refund, PRIOR to kelm signing lease. and from reading all this, kelm doing all this vacationing and not answering phone and moving and leasing and crap. i think kelm got the v-m and signed the lease anyways. in that case, i believe the refund shoulda been issued to nate within 30 days unless a repayment agreement was reached mutually

Why? because he entered into an agreement we had to get the place and left me stuck handling the rent I couldn't back out or otherwise I would have lost the deposit I put on the house to hold it for me and him.
Now I'm paying rent I have a hard time affording, because I should only be paying half 50% because he should be here,
Any person I sit down and explain this too is like what? he wants money back right now? no landlord is gonna do that, ding ding.
Hopefully I'm able to keep paying rent and get my deposit back, ****'s hard by yourself... I got full attentions of giving him the money back in July, I don't think he deserves it personally you hype me up to move in I get the place, they run background checks, I went through a lot of **** and then you decide not to come? that is the point of a deposit to protect the parties involved. him to me to landlord, easy as that. cya in July

see how worthless verbal agreements are in the real world and not on paper?
edit: and by on paper, I mean the law that is written. Don't mean **** if you don't have proof. video/audio proof.
