Well you went to the hospital, which is very important. Record any witneses. Keep a diary/record of the pain (is it sharp, throbbing, does it come and go?), what actually happened (have you walked down that area before, where you were going, where you were coming from, weather, the length and width of the dangerous condition, etc) you will forget and lawyers like to stump you when you're giving testimony, note the medicine you're on and what the doctors told you at the hospital, was anyone with you? How dd you get there? go to a regular physician for follow up and request a recommendation, eventually a physical therapist. Don't stop treatments. Chart all the dates you receive treatment. Keep a record of all your bills, days off from work, etc. Make a list of things you can't do because of your injury, run, ride your bike, chores, etc.

Pics of everything...injury, area where incident occurred. Bring it to your lawyer, but retain a copy of everything.

That's a difficult position to be in. You can contact the trailer trash insurance company or preferably, write a letter to them requesting the payment of the deductible, but they probably won't honor it. Do they even have notice of the incident since there was no police report. Did you insurance company attempt to contact them for reimbursement? Sounds like you only went through your own insurance company.

I think the only recourse is to sue for reimbursement of your deductible, but the cost of filing a small claims suit again the company is probably more expesnvie than the money you want back.

Here the deal, personal injury lawyers should only retain a case based on a CONTINGENCY FEE, which means they only get paid if you win or get a settlement. They usually request 1/3 of whatever you get. You don't pay ANYTHING out of pocket, make sure you read the retainer agreement carefully...lawyers are grimy.

ive gotten lawyers from in town and outta town, but for other reasons, I mean it just kinda makes sense, i don't think a lawyer from the same city would sue a city that he lived in, the county or w/e....

I don't think it matters. So long as they are admitted in that state. The one's in the city probably have the most experience with claims against the city and the most political connections.

well how big was this defect? if it was large and dangerous...then your chances are good. Although the city has a reasonably time to plow the snow away, if it was an unreasonably dangerous condition, then case law states that it should have been corrected.

I doubt you'll be a millionaire tho.
