EPA and loud pipes

I stole this off another site but felt it would be good for you guys to read though
if you have the time....

Good News PPL, I've just had a read over the Australian Vehicle Standards
(AVS) and found and interesting "out" for those of you who may get pulled
over by the police/EPA for noise testing.

The EPA may want to preform a Stationary Noise Test on your bike.

The noise limits on your bike are:
ADR39 (most bikes manufactured prior to Jan 1 2005) Limit = 94dB(A)
ADR83 (all bikes manufactured from Jan 1 2005) Limit = No ceiling, however
the EPA will use "Whatever is on stated on your original Stationary Noise
Test label as supplied by the manufacturer)

Here's the key to not being tested by the EPA. "Claim that your bike is
compliant to ADR83 as allowed via AVS Rules 1999, Rule 20(3)(a). Remember no
upper limit! on ADR83 you must however pass a "Drive-by test" which does
have a limit, however it also requires a set-up that cannot be achieved by
normal roadside testing.

The AVS says that your allowed to comply with ADR83, even if your bike was
homologated to ADR39!

If the EPA say they are going to do a Stationary Noise Test on your bike ask
them to perform a ADR83 test.

"Go get em troops"

Australian Vehicle Standards
Rules 1999

Australian Design Rules Part 3
Compliance with ADRs Division 2
Rule 20 Compliance with third edition ADRs

(3) a vehicle, or equipment fitted to a vehicle, need not comply with a
requirement of a third edition ADR if:
(a) the requirement is replaced by, or is inconsistent with, a requirement
of a later version of the ADR applying to the vehicle or equipment; and
(b) the vehicle or equipment complies with the requirement of the later
version.

Bad news... if you have an after market pipe you MUST have a sticker on the
exhaust which identifies the pipe and indicates it's noise level. Fine =
$200. "Go buy your self a CAN-KIT" $20 at all good bike shops.
.........
so there you go good stuff to know.
