Good Evening Gov Crist,

I had a question regarding the new motorcycle laws in Florida.

First, I would like to let you know we voted for you and are very pleased with the hard work you have done and will continue to do so. We agree with a majority of the laws that have passed as well.

Gov Crist myself and others have a somewhat different hobby than most, we stunt and perform tricks on sportbikes. Now we in no way affiliate ourselves with the irresponsible riders that do crazy tricks on public roadways and streets endangering innocent drivers and others sharing the streets. Most of us in our group are very responsible and respect all others well being. The majority of us trailer or tow our motorcycles to the designated location as we have our bikes setup to stunt and not be legal for PUBLIC roadways. We respect the laws.

Now we were practicing tonight in a PRIVATE parking lot in which we were given permission to from the owner. A Pinellas County Sheriff's Officer pulled in to the lot and watched us and even cam over to us and let us know he was amazed at us and how we are nuts to have a hobby like this and then he watched some more and then left. Soon after a second PCSO showed up, drove over to us and said if we dont leave right away he will write us citations for the tricks we were performing.

Gov Crist, we would like to know if the law pertains to our situation in an owner approved PRIVATE parking lot.

Please let us know what if the law is for PUBLIC and/or PRIVATE properties. Thank you so much for your service and time.

 

Hopefully you get a good responce. Man florda used to be the stunt haven now it seems like with all the new laws it is harder and harder to stunt down there. I hurd they can take your bike away from you for doing a wheelie is this true?

 

I think they can do pretty much anything if its on PUBLIC roads. Thats why we need to clarify this. So next time I can go over to the cop and tell him, "Sorry Officer, YOU ARE WRONG"

sorry talen but in florida if the lot has public access then you are held to all the same laws you would be held to on the main road ..

Roger is right! But there is always a way around the law to actually make it not applicable which is prevent public access!

Barricades and signs just like any road crew can be purchased and transported to restrict public access and be clearly visible with written warning and color warning! In a private lot with permission, have the permission letter on hand, restrict the access and you are good! Remember this, If you think the officer/deputy is wrong/mis using his authority ask for a supervisor or just call for one in front of him. Video the interaction with your phone or camera in case you have to go further in the future to their internal affairs ect.

we had permission at lot up here and the cops showed up and tried to shut it down. They threatened the riders with careless driving on private property. i wasn't there but the riders that were complied and left. i later went and talked to the chief of police and explained our situation and he was very sympathetic. He said they would look into it...........

A week later he called me and said that he and the city attorney had decided that if we had permission and we blocked the public right of way, we were in no way careless or wreckless. so we were in the clear.......







Until someone got in the owner of the property's head and filled it full of liability nonsense. so we are no longer allowed there. I wish there was a genuine contract that would hold up in court that would fully release the property owner.....then we could stunt just about anywhere.....anyway, good luck!!!

 

i suggest looking into Louisiana law for offroad/sporting arena's and the liability laws for them

YOU MUST!!! make all public access points to said private property inexcessable. i was told if you ride in a private lot or a public lot, it becomes detatched from the roadway as soon as block it from the roadway.. we use cones and never have a problem. The cops won't even come on the property.

 

I believe you with what you are saying, but this has to written somewhere. We would like to see the actual rule or law to print up and have on hand.

And what constitutes as blocked? I mean is a long as rope and 4 cones or something for the corners gonna be good enough?

 

The 2 citations they can write you on private property are WRECKLESS DRIVING & D.U.I... So YES these apply to your situation I personally have been tackled in a parking lot while trying to get off my bike by a cop. And It felt like I got hit by someone who played either in the N.F.L or an Arena League. NOT COOL

 

i have been tackled in a parkin lot and pepper sprayed .. well i was tackled for not leaving THAT SECOND the cop told us to.. and i dunno maybe tryin to save my face from being smashed into the pavement might look to a cop like i was tryin to fight... i didnt think so..

 

So your tellin me if a cop see's me doing wheelies in my driveway, I can get a citation?

PS if the wheelie laws are so black and white how come shows and events dont get people citations? Damn the cops should have a field day at SW10 writing tickets this year!!!!

 

Bro U can be mowing ur own lawn on a riding mower and catch a D.U.I, my buddy here did. Got another friend who was riding wheelies on fiddy with a beer in his hand and went to jail for D.U.I too
