u never ever blow. it is a form of interrogation and always request your lawyer to be present. they HAVE TO LET YOU HAVE YOUR LAWYER PRESENT. so at the scene of where you get pulled over, you call him in the middle of the night and tell him to take his sweet time getting out of bed. most of the time if you have been cool w the cop, he will not wanna babysit you until morning when your lawyer shows up.

I REPEAT ONCE AGAIN, NEVER BLOW. IT IS THE ONLY EVIDENCE THEY CAN USE. IF YOU DONT BLOW IT IS ON THE COPS WORD AND THAT CAN BE OVERTURNED IN COURT WITH A LAWYER. please take my advice future drunk drivers

hate to tell you this, the cop doesnt have to wait. i went through this with my lawyer during my DUI case. if a cop requests you to blow, you have the right to say no. if you say no there will be no DUI but you will automaticly loose ure license for one year(cali law atleast).

I got my dui dropped due to the fact the cop was a idiot!!!! FTP. good luck

exactly, if you dont blow. there is no hard evidence of you being drunk. im not saying hes gonna wait on the road with you. he will put you in lock up but by the time ur lawyer gets there, he will make a few phone calls n it could be over at that point (if you have a lawyer thats in the good graces of a judge). if it even goes that far, ur lawyer will get it dropped in court n you get ur license back in no time

in cali i had to see two different judges, one was a DMV representative who dealt with the idea u get ure license back or not....there pretty harsh. the other judge was a criminal judge and just gave me a slap on the wrist for violating probation:YEAH . the dmv though i know in cali will take ure license no matter, you dont get the dui but you loose it for a year. sometimes once u get a dui depending how bad it is, you can request for a temp license and they will give it to you.

Each state is different, You are way off on your weight of evidentary value of the breath test, and it's not the lawyer nor the judge that drops/reduces cases, Judges do alot but thats NOT one of their functions....It's a state/district attorney that makes those calls!

I heard from a reliable source that one of the "loop holes" for sobriety tests is that the cop has to be certified to administer the test. If the cop isn't, then the test is not valid. Check with your lawyer. Good luck!

A good lawer is definitley your best chance.

ya, that's a tough one. it sucks too.


one of the guys i work with just told me about his DUI last year. it's .08 here in indiana, he blew .08 and he got a DUI over it. I think it's because the limit is .08 and above, meaning once you hit that mark, you're done. Because of first offense and the fact that it was so low he is off on probation with some community service.

If he serves out his probation without getting nailed again it won't go on his record. I guess that would be your only out, i don't see them dropping it completely.

also, the .18 in the field doesn't matter. That's just their ticket to bring you in. They have to retest your BAC on a calibrated machine 20 minutes or greater after the first breathalizer to be accurate. Otherwise a lot of people would be in trouble. On my pocket breathalizer (accurate to .01%) i can blow over .2 a half an hour after i rinse with mouthwash! So basically i could get nailed for DUI on my way to work for using mouthwash....

In PA and NC if you refuse to blow its an automatic suspension above what the dui suspension is. Lawyers are scammers on dui's. I had 7 charges so I waisted 1000 on one lawyer and then got a new lawyer for 2000 and didn't get out of a single charge. DUI is one of the toughest things to get out of. Plus they say it won't go on your record but it does because nobody will insure me for full coverage. Good luck with that man it's a shitty experience.

yeah dude everybody knows that or should know that. if you know you're fucked up you never blow. you refuse. and you dont talk to the cop either. just short yes or no answers. so he cant say i smelled it on his breath.
so you lose your license for a year but big deal. everybody that owns a bike has dealt with that before and that dont stop nobody from drivin or ridin.
but nobody should be drivin drunk anyway. what if some stupid drunk driver killed your family while you were on the way to dennys?

If you've ever been too a court where they run the DUI cases before the traffic offenses you would of seen that the judge usually verbally whoops the **** out of the dui offenders. Anyway, your idea about defending yourself reminded me of this...

They are going to be harder on you due to the CDL because you are paid to travel on the road. You should make better desicions then the normal personal vehicle operator.

Some guys I used to work with would eat a huge glob of peanut butter before taking a breath-a-lizer. I think it works since the always drank at lunch and still work there. You should also take deep breathes before you take it because it tests the air in the bottom of your longs.

i would be willing to bet that 50 percent of people 30 years of age and older in the state of WI have dui's on their records......

Ryan, you're right about the 50% thing, and I bet it's even greater than that. In the ten years that I had the bar, I watched customers & friends drop like flys with DUIs. It's all about revenue and big money, with the insurance companies lobbying politicians for tougher penalties. At first a DUI stayed on your record for seven years, then it went to ten, and now indefinite... you now pay SR22 high-risk insurance for life. $$$$! On the local level, only habitual offenders (mulitiple times) are required to intall an ignition interlock breathalizer device at the violators expense. I hear that a person is only charged about 75.00 to have this devise installed at the county. This means that the manufacturers could install these in every vehicle for pennies on the dollar, and there wouldn't be anymore DUIs ...no more DUIs = no more money trail! Sure there's a safety issue, but I see more of a revenue issue than a keeping people safe issue. Its kinda like you're vehicle 'banging-the-box' at 100-105mph. Where's there a 100mph speed limit? From local government, to attorneys, to corporate america, there is way too many people making way too much big money at the average american's expense. It's almost like we're their prey. We're almost like the victim and not the violator. One little thing that you might have in your favor regarding the CDL and your day job ...you're boss has at least one DUI under his belt and he should understand your predicament.

lol my boss has 3 under his belt

but yeah, all vehicles could have breathalizers installed and there would be no drunk driving but like anything in this country---big buisness rules.
