Ryan, that sucks! I saw you late last night and you weren't even buzzed!... I was the **** faced one. Did you get it leaving the bar we were at? (NO NAMES...JOHN'S A GOOD OPERATOR) Here's the poop if you did get it leaving there... The last big party this past spring, a guy got hit by a car and killed when he was walking home after being there... well to make a long story short, the sheriff's dept is pointing fingers at this poor bar owner like its his fault. They are gunning for him bad, and you got caught in the cross-fire. There was a big article in the gazette just two weeks ago regarding this incident, and how because of it, the county is going to impliment a point system on area taverns so they can better control them. The bar owner is under heavy fire, he knows it, and has an attorney working on this f-ked up mess right now. My suggestion is to get an attorney on this asap, and have him contact the DA asap regarding this. Me being an X-bar owner, I'll say it 100 times... this bar owner is very good, responsible operator, and he's on top of his game. The powers being just want that annual spring party to go away, and they're pushing hard on that location. Wrong-place-wrong-time... it sucks, but it's as simple as that. It is .04 in Indiana too wether you are in a big truck or your own personal vehicles. I believe it's a federal DOT regulation and not just a state law.

You did the right thing blowing.....if you refuse, they will test you anyway either by blood or breathe but you'll will get an automatic year suspension for refusal to blow...Dont know about your state but here in cali when you get you Drivers liscense you agree that you will submit to testing for alcohol if a police officers feels you have been drinking, they dont have to read your rights when you get arrested either......Best thing would be to obtain a copy of the police report....see what the police officer is stating because this is all the DA has to go by. Try to get the charge reduced to a wet N reckless....I did and blew a .09 and hit a curb.....it was hard and they will most likely not want to but keep pushing them A wet n reckless will become a full blown first dui if you ever get another one but the fines and points are less. so is the class time...I think its like 12 or fifteen hours of DUI class versus the 30 hours for a normal DUI. Good Luck

In Illinois it's .08 . If you have a cdl it's like .04 .

If you got tickets , you are going to court . The CDL is gonna make it worse . Probably automatic suspension .

thats wierd you would think your b.a.c would be higher by the time you got to the cop shop....i bet you could get that reduced to a wet recklace...(depending on your laws)im on my 2nd dui and there is alot of kids in my classes that had there dui's dropped to wet recklaces because they were at the legal limit

my buddy jon just got a dui... he ate **** cause he was speeding and his bike hit a truck... cops roll up and have him blow. blew a .09 on scene and then at the station blew a .07

Hes getting the book thrown at him, but its also in cali...

and it was also right outside of base where cops hate marines

you dont have to blow until you get to the station. everyone thinks you have to take a field sobriety test. you do not. however they will tow your car and take you to the station to there accurate bac machine. if you do not blow there you then loose your license for 1 year. and field sobriety test are admissible in court. at l;east in washington

in cali though as soon as you deny blowing of the field test, BAM your in the car on the way to the station.

They used to give you the option thought for blood. If you chose blood they called a ambulance, took you to the hospital and by the time u waited and got your blood drawn you were under the limit. Not sure what happens to your car in the meantime though

Thats sucks. A lawyer will be a smart choice. Also like said get a copy of the police report and see exactly what it says. Good luck & I hope they don't **** with your CDL

ryan,

if you think you should fight it, start by picking up the discovery at the courthouse. read the cops notes, etc..

honostly man if you did not pass the sobriety test you are considered legally impaired, regardless of what you blow at the station. however you should definitely consult some legal advice.

i know in arkansas cdls are held to a different level of accountability regarding dwi's in terms of bac as well.

i was good friends with the warrant officer, a few patrolmen, and my pops was friends with the judge back home, and i STILL didnt get out of my dwi w/ a lawyer. the officer, who arrested me, didnt accurately perform 1 of the sobriety tests however it still didnt get tossed. dunno man, ive fought many tickets. some were easy, some were not. ive seen buddies dwi's get reduced sentences, esp for 1st time offenses.. but one things for sure though, DWI's are hard as **** to get out of.
