Stunt Waiver

Here is the deal:

Here in Colorado Springs, there are very few good spots to stunt (that are hidden). All the places are known by cops and we are kicked out within 1/2 hour. Thay have started to give tickets (they used to just tell us to leave), so we need to find a place to stunt "legally".
So I have decided to try to find some private property, and approach the owner. I’m trying to set something up, where if we signed waivers and paid a small fee, we could stunt there without any worries..

I am wondering if anyone has some kind of waiver that they use.
Something that they use for shows or contests. Anything that will release the property owner of all responsibility.
I know these are used and I'm hoping someone has one I can use (of at least look at to get an idea of how to draft one up).

Any tips on how to approach a property owner and ask to stunt on his/her property is all appreciated.

If you have a waiver and cant post it up here (word document or some other format) let me know, I will sent you my email address and we can work it out that way.

If there is more info that is needed from me, please feel free to ask.
Any help would be great.
Thanks in advance for anyone help.

Because of insurance, law suites, and other legal issues, you will have a difficult time getting a signature unless you can provide a bond to repair anything you might break, private insurance, and medical personelle while you're on his/her property. Your best bet is to find a new location, don't tell ANYBODY about it, and enjoy it until the cops figure out where you're at.

Re: Stunt Waiver

Go a google search for liability waivers, you usally have to pay to get more than one and somehow they block the copy and paste method, but you can get a general idea on what you need to type up.

Re: Stunt Waiver

I have been thinking about this for over a year now. When you have documents, you look a little more professional anyway when you approach a property owner. Also, unless an owner is calling the cops on you to be removed from his property, the cops cannot kick you out unless you are making excess noise or something that they can be stoopid about. A verbal from an owner is good enough in that case.

I am going to my lawyer today or tomorrow and will bring this up to him again. I will let you know if anything good comes out of it.

Always remember that it is always easier to do the wrong/lazy thing. This aint gonna be easy so keep your head up and fight the good fight.

Good luck, godspeed

Re: Stunt Waiver

Yea.....people in general are afraid of that sort of thing (signing shitt). Just ask and get verbal permission, but keep it (the stunt spot) between u and just your crew or a select number of people. Always be truthful, let the owner know exactlly what u'll be doing and who all will be there. If people start "Whoring" your spot, that's where the owner will start to become overwhelmed and ask everyone to leave and eventually close the spot down to all access.

Re: Stunt Waiver

WOW! thanks for all the responses.

maybe i need to clearify some things.

i will only be asking the property owner for a verbal ok. I plan to give them a waiver signed (and notarized) for the people that plan to be there.
This way when the cops come we can say, "we have a OK from the owner, they also have a waiver signed by me"
then the only way they could kick us out is noise/any other little thing they wanted to kick us out for.

as for "finding a good spot and keeping it secret" that isnt gonna happen.
this is a small town and there isnt much industry here. so big lots (99% of people here are NOT rocking slow stuff yet) are few and far between. all the ones that are around here are right on a main street where the noise/nikes will not be able to hide.

Re: Stunt Waiver

Talk to Jagman with Psychogang. They have a sweet setup with the local dragstrip up their way, not only do they practice there, but they also hold their anual Psychofest there as well. You can get in touch with him at jagman@psychogang.com or go to http://www.psychogang.com

We are actually working on a lot in our local area as well, but it is best to get written permission from the owner so when the cops show up, you can show them that the owner is aware of your presence, or he will just haul you in!

Good luck.

Re: Stunt Waiver

you have to remember, a liabilty paper only covers YOU if you fall and hurt yourself.........what if your bike takes off (on high idle) and hits a piece of the peoples property or some thing like that..........

believe me, ive looked into this MANY times.......of course, you may have an easier time where you live. Cali is full of sue-ready lawers, so no one wants the risk out here

either way good luck bro

Don't pay him. If your paying he needs to have a ton of insurance for that kind of thing. Would be like paying to use a motox place and they have a ton of liability then. Waivers aren't always good either, alot of times if someone does get hurt the waiver won't hold up. I am trying to go the same route as you and this is all stuff i've learned along the way.

The more effective the waiver is at specifically stating what will happen if and when you crash.......

1. Will not sue if/when motorcycle causes personal damage.....
2. Will be responsible for due costs if/when motorcycle causes property damage.....

Also, clearly stating what COULD happen (assessed risks) will make your document more precise, not broad and vague.....
