What Are My Chances ?

Here's my story...I bought a GSX-R 750 almost new in 2001 .In march 2002 the warranty was coming to an end so I decided to buy the extended one . This summer the cam tensioner was busted and they changed that no questions asked . 2months later a valve comes apart and pretty much travels throughout the motor and caused alot of damage...$5 500 worth . So I bring it to the dealership where I got my extended warranty and they tell me "we'll call you when its ready" . They call me 3weeks later to tell me that the company that takes care of the extended warranties doesn't want to pay cause they say that the valve came off from abusing my bike . So here's is my question...I'm bringing them to court and I want to know what my chances are that I'm going to win ? Has anyone ever been in this situation ? Alot of people are telling me that it won't even go to court cause they have to fix like it says in my contract...which is what I'm hoping for cause I'm missing out on my season and if it goes to court it'll take a while before I get an answer !!!

they tell everyone that it is from abuse first. it is how they get rid of most of the cases. usually as soon ans u mention a lawer they jump on it. i would just keep pressing. they will give in eventually.

That's what everybody is telling me...still was a little worried though...thx for the reponse guys . Anybody ever been in this situation ?

no they are right. keep at em till they give in. people are trained to deny the customer at all costs. my bike got stolen and it took me over 3 months to get cash. had to call about 100 times

my bikes at the dealer for a damaged tranny.....they told me labor wasnt covered! it has only 4000 miles on it ....... still waiting to see what happens

Keep on em,

I had major issues right after I bought my 97 gsxr and I had it in there 3 times and rebuilt 3 times. They kept turning me down but every time I threatened em I got the work done.

I got a good one for this. in 2002, i bought a brand new R6. This was my 1st bike. didn't stunt @ all. with 212 miles 2nd gear let go. It took over 1 month & about 100 threatning phone calls from me to get yamaha to cover it. they said it was from "abuse". long story short, i did get it fixed and 500 miles it broke again. I caused a HUGE scene & got a 2002 R1 for $1000 more.

makes me mad just thinking of it.

dude thats exactly what happend to mine 2002 R6 ...... it was popping our of 2nd gear! ****ing junk man..... im in the middle of fighting with the dealer cuz they are ****in me bad.....
heres my deal.....i was 3 days over warrenty.....they chic at the service dept told me not to worry cuz its only 3 days she will backdate it and it will be covered.......i get a call with the quote for $600 in labor and $600 in parts but they said yamaha is covering the parts.....i called yamaha and they said they didnt see any comments from my dealer to RTA/yamaha......so the thing im really pissed about is that from day1 they said it was warrenty.....1 1/2 weeks later after the engine is off the bike i had to make a choice wheter or not to finish the job after they gave me the quotes........if i chose not to i would have had to pay labor for the inspection of the problem....wtf is such bshit.....so im really in a bind right now cuz its gonna be done soon and they were ****in me from day 1

Not true, They get told that they will have a lawyer after them everyday. It doesnt bother them at all. You will actually have to hire a lawyer to put some heat under them, even if its just a phone call. They will have to proove that it is from abuse and thats nothing they can do on most cases.

But anyways, just telling them your getting a lawyer wont make them do **** really.

havent heard any problems with honda's so far j/k, that sucks man, just keep at it and maybe you'll get a knew bike like these guys did.

I already have my lawer on it...he's going to be sending them a letter telling them that if they don't pay that they'll have to go to court . I hope all this won't take too long cause I hate not being able to ride
