cop question

so i'm cruizing on my bro's nice bike yesterday, out for a quick trip around the neighborhood. i pass a truck on a double yellow on one of my favorite roads withough thinking anything of it. at the end of the road, i do a small endo (it is my bro's bike and the brakes cant touch my 929 front end). So i wait for the car in front of me to cross the road and i follow, pulling into a garden store.

as i am about to get off my bike, the same truck i passed pulls up behind me and the guy gets out showing me some sort of license ( i wasn't really interested, nor was i paying attention). he says he is with the local pd and is going to write me a ticket for marked line violation and reckless operation and to meet me at the police station at 8 PM that night ( it was about 4:30 PM) or he is going to arrest me later on...i tell him i cant make it and after he goes into his truck to write the info down, i tell him that my plans have changed and that i can now make it and will see him at 8.

about 8:30 rolls around and i'm sitting at home when my roomate gets a call from this guy at the PD looking for me (they got his number from my own town's PD). my roomy tells him i dont live here anymore and wants to know why he is calling, etc. (my roomy doesnt like cops, but does like to eff with them). then the officer says that he has two citations waiting for me and that he is going to issue a warrant for my arrest...the roomy calls BS and the officer hangs up him three separate times.

my question is this, i'm in the clear, no???

just curiouis as to who knows the law....

Good luck man, you might be ok, since the plate was for your brother. Did he actually get your name? OR there is the old ' I thought I saw the guy in the truck wave me by'.

I'm not sure the cop could issue a warrant for you, even if reckless operation is a criminal citation, I think you would only recieve a citation or warrant to appear in court at the worst. Couldnt see them aresting you for it. I'd wait and see if anything comes in the mail.

but, thats my understanding of how things are done in mass, not sure how they do it in cow hampshire

I had the same thing happen to me but I was in my car... I saw the officer comin the other way (was on duty) He threw the lights on and I took off........

I was going too fast down a side road and an old man caught my plate and called it in. The officer called me and asked me to come in and talk with him (I knew what he was doing). I told him I was working all night (16 hr shift), He was pretty persistant that I go see him in the next 24 hrs....... I never showed and nothing happened.


on a lighter note, I was on the same road passing a car 2 months and he was comin the other way..... I pulled over and he said he will consider that one a warning... then wrote me for like 5 tickets (everything he possibly could.... including littering.. I threw a cigarette out the window).


Yeah you should be in the clear.... at least you would be in Maine

I don't see how an OFF duty officer can right tickets. that is complete BS

Deny it all. If you get another call, tell the cop that he has nothing on you, and if he wants you'll have your lawyer contact him. I will be your lawyer for a minimal charge of a 50 sized tank of gas. I'm not 100% sure but when the cop is not on duty he is a civilian, and though civilians can detain you for breaking laws (varys by state) they can't issue you civil violations. The cops have nothing so don't give them anything. Hasn't the SPD learned they're lesson yet? I can't wait to see what the roomie does when they show up tomorrow. And stop doing stoppies on your brothers purty bike.

ya jay, you are right. it was next door in hampstead though.

joe is saying that if they wanted to give me a ticket he had to do it right then by calling a patrol car who actually had citations in the car...he did copy allmy info down, but if i went to court there would be no record of anything so i'd be in the clear i think...

i work for an attorney...he said that he's pretty sure that if the cop is in their jurisdiction that he has 24/7 ability to pull over/write tickets/arrest people...

It wouldn't stand in court... no way. No citation during time of offense, Not on duty, no license check, etc. It wouldn't stand in court and being a judge I wouldn't slap someone with those types of charges knowing it's a half *** situation. Those are serious charges and usually if the situation sounds fishy, judges throw it out. Cop didn't do his job correctly and it sounds like he's busting *****.

Don't let them BS you, keep your mouth shut and your ears open. Let them know you're not some dumb *****.

"I did not commit any civil or criminal violations, if you want to persue this I will have my lawyer contact you. Otherwise I want your harassing(buzz word) phone calls"

If possible record the phone conversations. I tryto record everything now since cops lie.

On a side note the other day I'm talking to my uncle, who's a leutentant, and another friend of his on the force about a ticket I just got. It's funny as hell to hear to uniformed cops call a state trooper a '****ing *******'.

oh, i'm pretty sure it wouldnt hold up in court bri...you are right, it is a serious violation, but for some reason not serious enough for him to call a squad car to issue me a ticket then, and somehow not serious enough for him to come to my house to give me the citation...

it is not my responsibility to take time out of my day to go to the cop station and pick up my ticket...he even tried to get my roomy to deliever his 'message'....i dont mind court, cuz i'll win, but i dont need to get arrested anytime soon!

Might want to have someone run your info (cop that you or your family/friends knows well) thru the system, make sure that cop that talked to ya didn't put out a warrant for ya...rather find out when you are at home compared to the hard way, like getting pulled over then arrested...would make that whole week just suck...

I had this happen to me but i was in a car. I was racing through a residential neighborhood having a good time. I was passing cars on a double yellow trying to catch my friend. One of the cars I passed was a off duty cop. He follows me, i Try & loose him but he saw me ditch my car. Took down my info & had me go to the station (hey, i was young & stupid so i went). wrote me a 500 dollar ticket for everything he could think of). Stupid me.

But, a cop is on duty 24/7 w/ the ability to write tickets & such.

But i think if i didn't to go the station, or was smarter I could have gotten out of it.

You can just call the police station yourself and find out if there is a warrant. Dont mention anything about the off duty cop though.

Chris- If you dont have any issued documentation in writing for a violation or citation, than there isnt that much the po po can do. If they try to press it, save yourself some trouble and get a lawyer, its worth it and9outa10 the charges will be dropped. by the way, in most states you have the right to any information on your record, and sometime it is public. good luck.

teach, betta watch yourself. this crap happened to me twice when i was 16-17.

1: off duty cop seen me driving wrecklessly around town and running stop signs. they called me down to the station and had a stack of 6 tickets for me. wreckless driving, 4 stop sign violations, and a speeding ticket.

2. off duty city worker, said I ran a stop light and about killed him. the cops issued me a ticket later on that one too

first ones, i hired a attorney to throw them out and paid the fines

2nd one i tried fighting by myself, thinkin there was no way to prove it was me driving. I LOST! had to pay fine (reason i lost, was that the officer came to my house at 2am, woke me up and asked me if i was driving my van around 6m earlier that day! Me not thinking i had done anything wrong said YES, I would have just gottn off work) that question and answer made me GUILTY!!!
So if you talk to anybody, dont answer any questions without your attorney present!

the system is wrong sometimes, I'd def hire a attorney!
