If I sold a bike on payments to a friend and he has not followed up on his end of the deal and I repo the bike what good would a handwritten bill of sale do him in court. I still have the title and the bike is still registered in my wifes name. I should be able to take the bike back and have nothing to worry about right? Anyone?

If the bill of sale states that he is to continue making payments don't worry about it your in the clear.
If not and he takes you to court they'll probably award it to you since its your debt.
The worst thing that could happen is that the court awards him.
If you don't pay he could put a lean on your property or whatever. Thats about it.
What bike are we talking about and how much is the payment?

If you wrote a bill of sale and gave him the title (With out) putting pay in payments. Your most likle screwed. But if you put in the bill of sale that it would be paid in payments. he has to come up with the payment record that you have made out and signed.
Hell he could pay you everything and you could be a dick and take it back if he had no written statement by you.
And if you have the title just take it back.

Here's the whole story: I sold my wifes 02 R1 to a friend of mine for a down payment of $700 at $300 monthly for a total of $5500. The original understanding was a down payment of $2200. He was supposed to sell this p.o.s. Blazer and an old *** Honda 4trax four wheeler he had for $1500 to go along with the $700 that he initially gave me. He never came through with the $1500 but being the nice guy that I am I let him slide. He's come through on the monthly payments but he's been about a week late every time. This guy was also my business partner and he fucked me out of my job and then he was still late with the $300 dollar payment. I told him tonight he needed to get a loan and pay me in full. He started acting like a bitch so I told him to just give me the bike back.I told him I will give him his original down payment of $700 back but that is all because in the meantime of having the bike in his posession he has managed to wreck it going like 80mph. The bike is still registered in my name and I still have the title. Am I being unfair about the whole thing??
by the way we have no payment record but I'm not trying to douche him out on the money he's already given me.

No, there was no notary involved. Dude just didn't have good credit and mine was alright at the time so we financed another bike for the wifey and sold him this one on payments. Lesson learned I guess.
