Traffic Legal Question

Had a rough weekend. Anyone what it takes to be considered careless and dragracing? I was cruising at about 95 with a viper, pulled over thinking I was only going to get a speeding ticket.
Wrong... accused of dragracing, and given

-careless, ticket
-wreckless, written warning
-dragracing, written warning

Going to be screwed next year on insurance renewal.

Get a lawyer...have them argue for you that you weren't racing...and the Viper kept trying to so you sped up to get away or something....it's a long shot but worth a try

sounds to me like they just gave you a warning on the dragracing. In which case, you just have to worry about the careless. And 30 over... well, that falls within the laws definition of careless.

Get a lawyer, try to get them to knock it back to 15 over. Take your points and hope insurance doesn't find out.

Did they pull both of you over? Did the Viper stop?

Depends on a few things, some areas the courts are very lenient and just want your money so with a lawyer he may get you off with nothing more then advisement. Eitherway figure 250 for a lawyer and whatever fine is assessed along with the ever present court fee.


On another note along the same lines, friday my brother and i went down to 13 and woodward for thai food, on the way out and back to our bikes i was having a smoke before leaving, cop stops us and tells us we need to leave right away because they do not allow "gathering" wtf i just got done eating, hell my brother was still holding his takeout box in his hand. I explain to him im just having a smoke before leaving, he then says and BTW your helmet isnt approved (i was on my vrod he was on his cbr i had a skid lid totally not DOT and i know it but never get bothered) anyways he let us go without doing anything but i was annoyed none the less. So we leave and are going home cruising up woodward, around 16 mile or i speed up and am leading doing about 75 or so, my brother is 2 lanes to the left about 8 carlengths behind me. Anyways i get to the light at 18 mile and hes not there, im like wtf, i turn around go back and hes pulled over at 17 by an unmarked cop, of course i wasnt going to pull right next to him cause i figured i was leading cop might have been looking for me as well, but when my brother got done and met me at the gas station at squarelake and woodward he said said cop let him off with no proof of insurance and never even mentioned the "other rider".

Just further proof that if your on a harley and flying around your still less likely to get stopped then you are on the ricer.

I used to sell insurance and if I were you I wouldn't be so worried about the cost of your renewal b/c your insurance will drop you when they find the points if you don't get that drag racing or reckless driving off. You'll have to find a high risk company that will allow bikes (Titan is one for cars but I don't know about bikes) It's gonna cost more to insure the bike than the payment! Your insurance can't apply the points and drop you from your insurance until your renewal but after that if they do a spot check your gone.....sometimes insurance companies only check once a year but mostly every 6 months. Your best bet is a great lawyer.

Just over a year ago... my license was suspended for two weeks, and then after a hearing, eventually restricted for 5 months. I was at 12 points. 3 for a wheelie on the bike, and the other 9 in the Camaro.

My insurance never found out, it never went up, I never got dropped. During that time, I also made four seperate claims on the Camaro, one for a break-in/vandalism and the other THREE TIMES for getting hit.

That's why being 25 is such an in between age. You start to feel weird dating high school chicks... but your insurance is dead cheap.



Edit: I should add, that the one claim that will probably end up getting me dropped (now that I have zero points and haven't had a ticket in almost two years) is from when some stupid f*cking pedestrian, walks in front of my car, and then sues me.

That's rare, unless your points fall off before the company your with does what they call a spot review. There's always miracles like that but I wouldn't count on it.

im a police officer for a metro city in the area all you got was a ticket for careless driving which is usually 3 points warnings mean nothing except if you go to court the judge can say he wont give you a break cause the officer already did

I'm not sure if insurance companies deceifer between Reckless driving and careless driving but it isn't 3 insurance points a "high risk" 6 which is just as bad as a DUI on your insurance policy.....
