Thanks to our lovely governor GrandBiatch any and all speeding tickets now are points and do go on your record. It used to be that you had a buffer, either 5 and under or 10 and under(can't remember which) used to be a no points offense. Now, probably at the request of the insurance companies (accompanied by some 'donations' or a trip to the Bahamas) any and all speeding tickets are points. Not only that, but if you go to court and lose, they can find you guilty of the full amount of speed indicated on your ticket.
I got a ticket from a state cop in Newberry in the UP. He wrote it for 5 over but put on the ticket that the radar got me for 77 in a 55. I was headed out to Alaska and called the court a couple days later to let them know that I wanted to fight it but would be gone for 3 weeks. They were surprised that I wanted to fight it because if I lost I would be charged with 22 over instead of 5. I ended up paying the ticket because I didn't want to get a lawyer and head all the way back up to the UP and run the risk of a higher ticket. Yes, a lawyer may have been able to save me, and if it had been in Flint I definitely would have done it. The first thing I would do would be to call a lawyer and ask them if in Flint(or whatever court you have to go to) that they can charge you for the speed the radar indicated. You can call almost any lawyer and get this information for free over the phone. Get the facts before you show up in court and get a surprise. Different states have different laws so be cautious about internet advice. Talk to a laywer or the court itself.

Thanks jake, that's what i thought by the reply the cop gave me when i asked him about taking it to court. he said the magistrate would look at the actual and give me the bone (NOT an exact quote but you get my point)
BTW Ryan never got back with me when I hit him up on the Nextel, hope you figured out your problems...

I might be mistaken, but I thought that tickets on the freeway were no points? Am I right? Not sure if that matters though?? Is it the points you're worried about? Or just the ticket itself?

I have never heard of charges being altered to something higher than what you were charged with. Perhaps this is the difference between the Informal Hearing and the actual Bench Trial.
Magistrates preside over informal hearings - not bench trials. The Prosecutor can change what you are charged with prior to the hearing, such as Impeding Traffic or Disobeying a Signal. It does not have to happen at the incident, but it can't hurt to ask the cop next time due to the circumstances. I prefer to get past the Magistrates, as they most commonly abuse their discretion.
If you think you can't get points on the freeway, you're ****ing stupid and should not have a driver's license.

I got a ticket in Livonia last month.. I was doing 15 over and the guy was just soooo nice that he gave me a five over.. My insurance just dropped so I made a court date to admit guilt, but to beg the judge to waive the points.. The ******* looked me right in the eyes and asked me why I was there. I told him, and he said he has no control over the points.. That the secretary of state is responsible for the assessment of points.. He then asked me if I wanted to basically beg the cop to drop the charge to something without points.. Of course I said yes.. So now I have to go on the 14th and beg this **** head cop to drop the charge to something else.. I'm just praying he wont show up....

Jarsh fight it but I wouldn't waste money on a Lawer. If your record is clean most the time you can go in there plead your case, tell them you are willing to pay the fines but would like the points taking off. They will usually rewrite the ticket to something that makes the fines equal to 5 over costs. My understanding of the law now a days is that it doesn't matter if the officer shows up to the informal hearing.
Also I doubt Coke will even know you have a ticket since it shouldn't be on the records till after they check your driver license. Usually they don't show up till after you pay the ticket or it is resolved unless you let it expire without resolving it. If they did see it odds are likely they wouldn't care unless you have a tons of points on your license or some other BAD charges against you.
