help with sponsor contracts

help with sponsor contracts

just wondering if the top riders out here have to sign contract of some sort with there sponsors......what does it cosist of ..the hole nine yards..............the reason im asking his with my shop full bike sponsoring riders what should it consist of for me to get something out of it and cover my *** against loss..........i give them a bike and then they tell me to go fu(k myself .............some input would be greatly appreciated or maybe even better a copy of one.........looking for some input by like Teach,kane,darius or anyone else that knows what they are talking about

the contracts i've signed have just been like you this product on certain parts of the bike, put this sticker here, only use our product, lada lada lada, etc. etc. etc.

well i own the bike ,clipons(vortex)sprocket(thrust)cage(ross)basicly it started out a factory f4i and i set it up for him and i also sponsor a rider for all his parts so just need to figure it out so i can get **** on paper

all i know is be kind firm in what you but not to harsh. or they will take advantage. i droped my sponcer myself because he did not hold up his end. im going to a new dealer who i know will help.

ares was we will have at least 20% of our movies with the sponsored bikes "Buell" we can not stunt them on any pubic road's with out permits and they are not responsible if we injure or kill ourselves and a lot more legalese type **** it's all about CYOA!!!!!!

with argo cycles, i have a handshake agreement: i do for them, they do for me. if i need something, they give it to me and vice versa....i just picked up a 3rd bike from them bc i needed on....unusual though and i dont suggest it, but i've been friends with those guys for years.

case in point why you dont do deals without a written contract: dealership i've worked at for 3 or 4 years finally stepped up and gave me a 450 to motard for the year. they were supposed the buy the wheels and then i would just get a new bike every year from them and swap the wheels. in return for that, i put their logo on my videos (drew stones vids), logo on my stuntbikes as well, do 2 shows, etc etc. i did all this, they tried to back out but i wouldnt let them...so now i'm stuck with no motard and bc i passed up opportunities from other dealerships and they backed out of our 'multi year' verbal agreement. if it is not written in stone, someone is going to feel cheated.

with a shop, look at it like this. the dealer cost on that 450 is around 5 grand and change after the rebates and whatnot. the bike was an 05 and sold last week for 4 grand. they lost 2 grand at MOST on the deal, but they got a whole lot in return. if i simply refer 3 or 4 pepole to them instead of another dealershp, they make money off of me, nevermind all the general advertising and indirect sales they get from being associated with me.

the contract with a shop should state what EXACTLY they are going to do for you, what EXACTLY you are gonig to do for them. it will release them from all liability if you hti someone or get hurt on their bike. it will state the time frame and condition the bike must be returned in. for me, i put new plastics and tires on it and then gave it back after a year.

with other companies, my contracts usually read something along the lines of:

1. rider will act professionally at all times, on and off the bike
2. rider will not endorse or use competitors products
3. release from all liability
4. it should include perks or other $$ options, like 500 bucks for a visible logo in a mag or something...a g note for the cover, etc.
5. usually has something about updating the sponsor every few weeks/months

thats all i can really think of right now, i'm in the process of handling all that for 07 right now.

if you want specific help on a specific sponsor, pm me and i'lld o the best i can to help, but that is the general idea. depends on what kind of sponsor and your relationship to them, as to what the contract will read...or if there even is a contract.

if its your shop sponsoring the bike, depending on the sponsorship i would type up a contract that legally covers your ***. if needed, get a lawyer involved to read over it. are you planning on getting the bike back at the end of the year? or are you just loaning the bike out for the year? whos name will the title be in? make sure the bike & rider has insurance and shows proof of it! there a million things to consider in a deal like this which is why its so hard for dealerships to hand out bikes. if your sponsoring the bike, its in your power to type the contract, which will include all the do's and dont's that you want out of the deal. some of which teach stated above. good luck!

Sponsorship contracts are very different when taking specific aspects into consideration.

in a nutshell a contract is nice because it should fully explains in detail what is expected of both rider and sponsor for a given amount of time.

every company is different. just becuase its written doesnt mean itll happen, and just becuase its not written doesnt mean it cant happen.
i preffer contracts, and require them for any advertising/title sponsorship tiers.
If a company doesnt have or cant supply one, I will for them.

My contract with Shoei is 18 pages long and goes into very specific detail
My contract with LP USA is 1 page and very vauge.

without going to into detail, the length of the contract doesnt specify the involvement of the sponsorship.

I dont consider free product without a contract a sponsorship, I consider that an individual or companies way of saying they support you as a person and are trying to help you succeed in whatever it may be that you are participating in. doesnt mean u cant return the favor and do your best to support and promote them. thats what i call a foot in the door.
