yeah we're a bunch of ****s. either way if something went wrong with his clutch then it'd be a maintenance problem and therefore by not having the problem corrected, the vehicle owner was negligent. By looking at the chain reaction dmg i see in your pics, we're not talking about a clutch problem. we're talking about someone that didn't pay attn to what was ahead. even if the clutch malfucntioned you can still shut off the car and brake. the operator was obviously traveling too fast too stop anyway. it's a no brainer you'd win in court easily. whats more realistic would be that the other ins company is looking at a limits issue since the middle vehicle is an obvious total. see how much your loss is and then weigh your options.
