was DD for boy last tuesday night at the club, we got split up and i ended up not seeing him at the end of the night so i took his car home. on the way home i got pulled over and taken to jail for driving while licence revoked. got bailed out and on the way back to my boys house (where my bike was) i see four cop cruisers and a wrecker and my bike getting towed. turns out my boy was drunk and thought i had stole his ride so he got on my bike to try to hunt me down. turns out he only made it about 50 yards and completely totaled out my bike. well i ran up to the cops and started flipping out about why my bike was wrecked and getting towed. at first they thought i did it but since i just got out of jail they walked me to my boys front door and we got his dad to get him to come downstairs and he admitted to wrecking it and taking it w/o my permission. he went to the hospital and then to jail for 3 misdemenaors: damage to personal property, hit and run, and driving w/o a licence. i talked to a lawyer and they are going to get him with a felony, either larcenry of a motorvehicle or unauthorized use of a motorvehicle. i hate to do it to my boy but i need to to help het his car insurance to pay for my bike. if that doesnt work im forced to bring a civil lawsuit against him but he lives with his parents so no money, just a judgement that lasts 10 years and be renewed unless of course he files bankruptcy but i get 8% interest until bike is paid for. is this the right way to go about getting my bike payed for so i can pay it off from suzuki finance and get a new one? am i completely screwed, if so why? what do you guys think? hopefully this has already happened to someone and i can get a good example...

I would talk to his parents first since your friend seems kind of irresponsible. If they are willing to pay, then I would just do it that way, if they curse you and wont do it, I think you have no choice but to take them to court... and then the judge decides.

Man you are always into some kinda drama.....Bro, listen, You HAVE to do what is necassary so insurance will take care of it. If not then court doesn't do ahit.

The courts only do so much. You have to start going back over and over for small claims. But yours is a cicil suit and will be harder. His only job is to not get one and you'll never see a fukken penny bro.

we were sitting at the spot and one of my other friends didnt have his bike it was at the shop, he has his beer musclles kicking and decided he was gonna go for a ride on another friends bike a brand new 954 and show off for the 60 or so people that were there, and he ended up looping out a wheelie at about 60 mph with no lid no jacket and no gloves on he luckly ended up rashed to all hell and a pretty messed up ankle and a trip to the emergency room the next day to get the rash off his face....he had to wait to go to the er because the police came and heard of a bike accident and he was pretty lit up and couldnt go to the er till the next day so he wouldnt get **** from the police.. thing was the guy didnt care about him wrecking the bike he bought it to stunt anyways and said he just broke it in for him

MIkeM, i didnt get caught. My boy dosent even ride bikes but he has more ***** than you ill bet my life on it. he just got out the hospital yesterday and his story matches up with the damage to the bike. he scrapped the whole subframe off to the front seat before he flipped it 60 yards off into the ditch. Anyways his parents wanted to keep his insurance out of it so they cut me a check for 14 large. I just dropped 7 of it towards a new 328i for the winter and i used the rest to pay off that bike. Now im just looking at either getting the brand new 04 gsxr or a honda 1000RR on payments. And the driving w/o a licence is already dismissed cause i paid the fines i owed on my licence for not wearing my seatbelt and got my licence back. if this is what you call "getting caught" i hope i get caught every time i ride! As for my boy, he got shafted but he was the one that decided to take my bike out for a ride when he was **** *** drunk, just lucky to be alive in my opinion.

Never cosign for anybody. I cosigneed for my best friend of 11 years. Now he says he can't afford it and the Retail Services people say I can't get my name off like the dealer told me I could. He wants to repo the bike so its gone but that Repo mark will go on my credit too so I am forcd to pay the friggin thing. I already have my own to pay for. I can tell you for a fact that civil court won't help any. Exactly like you said, it'll just mean they find judgement for you, but he still won't pay it. I had my interceptor taken appart to be painted, then the dude moved and kept the plastic and tank and left me with a frame and motor, (which also had a bad crank), I took him to civil court, he didn't even show up. They ruled in my favor, wupty do. He owed but never paid a dime of it. Every six months or so I'd go to the courthouse and see if there was ANYTHING titled in his name, if there is, you can take a memeber of the sherrifs department with you, and go take it, and it becomes yours. Well, needless to say nothing ever went into his name, also he never showed any sort of income on paper, he'd always have a job like carpet layer, or roofer, and get paid cash.
It has been so long now that the statuet (sp?) of limitations has run out, so now he could make money and own stuff and there's nothing I could do about it.
That's one thing nice about states requiring insurance. Get the cops to make him show proof of insurance, then contact them and deal with them instead of him. Most sheriffs departments will work with you on this, they tell him, turn it in or get another ticket, and so the person will turn it in.
That DID happen to me. A guy hit my bike at the races one year. He pulle in on a full dresses (old heavy one) and T-boned my gixxer. The sherrif was standing right there when he did it.
He didn't cut the guy a ticket or anything but he did get the guys name and address and phone number. I asked if he got the guys insurance information... "Uh, no, didn't think about it."
I talk to the guy, he never turns it in on his insurance, I call the sheriffs department, I contact the sheriff that didn't write the guy a ticket. He drives out to his house and says "I have to write you a wreckless opp ticket so the guy will have proof you hit his bike." Instead of getting the ticket the guy stood there in front of the cop and contacted his insurance company, which them cut me a check within a week.
Sorry that's so long, but since I've delt both with civil cases and insurance companies I thought you might want to know that.

the police report had no mention of a 12 oclock wheelie and my boy doesnt even know what one was until i told him. the only bikes he had ever been on were his dads 1200 vulcan and dirtbikes. i think he thought that since he had rode a 1200 he could handle the power but that 750 gsxr is nothing like a vulcan. he says he was trying to wheelie it and cant remember anything after that. the police report is funny though it says 12 o clock in police talk like vehicle A traveling south rolled backwards and caused property damage to the roadway as well as portion 58 of vehicle A, etc. etc. before coming to a rest on lot #39 sailview ln at which time the driver left the scene, blah, blah
