Legal Troubles.

DOES ANYONE KNOW OF ANY LAWYERS IN NH THAT SPECIALIZE IN SAVING MOTORCYCLISTS ASSES???

FOR EXAMPLE- 4 must appears on one stop.....er chase

1. reckless op
2. speeds in excess of 140 mph
3. failure to obey a police officer
4. failure to stop at a stop sign

I was arrested but never read my rights, I shut off the bike when I saw the cop, (i never saw him before I was just ridin fast) and he tackles me off the bike. I was put in lockup not told what I was charged with and never finger printed. Only 10 minutes before I was released was I given the tickets (only 2 of 4) and a paper saying what I was charged with. The next day I had to go to the hospital where my whiplash report was filed.

SO I ASK AGAIN ...KNOW ANY GOOD LAWYERS????

Re: Legal Troubles.

your probably gonna get nailed on 2 out of the 4 , but since they fouled up like 2 times on big stuff , id get a lawyer and get the charges reduced so you keep your L.

Ya... you have to be read your rights. If you can prove without a doubt that they were not read to you. I would say they have to let you go or reduce the charges.

Re: Legal Troubles.

Alright I was talking to my friend about it who is IPD... Im just a junior criminal justice major... So he knows tons more than I do. He says the cop witnessed the speed so, any admission that was given is irrelevant also, a cop only has to read rights if they are asking for an admission. So by what he says the fact that you were never read your rights will not help you... The only time they read you your rights is when they want you to admit to the wronge. But since they saw you going 140mph and blow a stop sign you dont have a case. Get a good lawer. GOOD LUCK!

Uh, yeah. They do NOT have to read you your rights UNLESS they plan on questioning you. If he didn't read you your rights and asked you questons other than the basics, such as "Who are you?", "How old are you?", "were do you live?" etc., then the case is good, but I would need to hear the scenario to understand what happened and give you better legal advice. Maybe I should have become a lawyer.....Love this ****.

I love everyone asking for legal advice on a stunt forum Cough up the cash, get a lawyer, and get answers that apply for your situation and your state.

AYyyyyyaa Carummmmba BOYYYY what have you gottenn yourself into?

Disclaimer: This information is not intended to be used as legal advice, utlize at your own risk. (sorry but I must cover my lawyer a$$)...

First- go to a criminal lawyer- any criminal lawyer will do and tell them everything in DETAIL. I'm not exactly sure who stopped you- state or municipal PD in NH- you must clarify. The first and foremost constitutional right you have is the 4th Amendment- search and seizure- so if you have anything relating to the arrest in which PD have searched and seized anything...mention it now...

Second- Miranda rights may not protect you here. For Miranda to be applicable there must be 1) a custody and 2) an interrogation. There are very specific definitions for both. Generally, routine traffic stops are not considered custodial, but then again it depends on the circumstances... do you think PD interogated you and should have reasonably known they would have received incriminating info from you?

From your description, broke the law providing PD with the necessary PC (prob cause) to arrest you. But then again I don't have all the facts I need to cousel.

Generally- I think whichever lawyer you have will lawyer will plea you down and you'll be fine...

Re: Legal Troubles.

THANKS TO EVRYBODY FOR THE ADVICE. I was questioned like how fast were you going and why were you running and what was I running for (what was I hiding), I was also asked what my speedo says every time I turn the bike on. why did I blow the stop sign. This was asked in the cruiser when I was cuffed in the back and also in the station in my holding cell.

thanks again to all GL to me
