Unlawful flight from police
Re: Unlawful flight from police
I wasn't asking anybody to bastardize my thread. And my F3 was plenty fast enough to get away. It is written in the papers that they were pursuing from no closer than 1 mile. The only reason I got caught is because I came flying into my neighborhood, opened my garage door, parked my bike and closed the garage real quick. Problem was, was that there was like 15+ kids outside. The cops simply asked them if they had seen a motorcycle.
So, I back to my original question. Anybody who has been charged with this... what were your penalties/fines?

Calm down, Bro.....I believe he's just joking, unless U're speaking of me which I wasn't joking. So, I was right about it's some what in nature of "Running". It seems like they can't get U for Felony Evasion 'cause they need proof that U saw them with the lights on and in pursute of U. So, since they can't prove that U saw them in persute of U, they got U for Unlawful Flight, which is the same as Running or Felony Evasion, except it's a nice way of saying U didn't know they were persueing U. I'll ask my buddy who's a Cop and see what can be done or if U can "Get Off" or "Plea Down". What was the reason that they started chasing U in the first place? Speeding, Wheelie, etc...
I'll get back to U.....
Doesn't Sound too bad, though.....Seems like a good Lawyer should be able to get U off!

Did the cops make u open your garage, Or could they see in it? How'd they know it was you if they was a mile behind you? Seems strange that a cop a mile or more behind someone would know what neighborhood to go into.

Re: Unlawful flight from police
Yeah, do that for me. Find out what the plea charges are and all that ****. Just hopefully no jail time. It was for doing a wheelie past them. There were two of them sitting on the side of the road doing radar, and I went right on by them like 60 mph sitting on my tank. As soon as I saw them, I put it down, and pinned it (trying to get distance). Thats where I got my mile distance that they never gained.
The reason they knew what neighborhood to go into, is because I live out in the middle of nowhere, and my neighborhood was the only neighborhood within 2 miles. And besides, they had reports from earlier instances that they chased me that I "dissappeared" as soon as I got onto my street.

Re: Unlawful flight from police
Why run home? If they got your plate # from a camera or witness, they will be coming. Always go to a friends house or simply get out of town. They will not put out a APB for a bike that juse ran, they figure you are home shittin your pants and an APB would just waste their time
Re: Unlawful flight from police
Heres is an idea DONT RUN, you dumb fawker. You are better off just stoping and taking it like a man . then get a lawyer and fight it. Sorry if Im flaming ya but that is how I feel, I hope it works out for you.

Re: Unlawful flight from police
Fu*k that I say run any time you can. If you got a good chance of not paying like $300.00 (most of the time higher) then take it.
I just ditched a cop last weekend and my wallet sure as hell thanks me for it.

^ Word to that
And a friend of mine ran a few days ago...saved himself some money, and the cop never got close enough to see anything other than, "Red and white bike doing a wheelie..."
And hey Crtchrktrcr, wait until Ken and I come out again...Ken's got fu*king blocks now, and can ride out first forever. Kid's getting better so quick it's scary. Now we need to get him to clutch second.
And I need to practice a lot more...once/twice a week ain't cutting it for sh*t...

Re: Unlawful flight from police
I also don't think felony evasion will stick unless they can prove you knew they were chasing you.on tape looking behind you is about the ony way they can prove that.deny you knew they were chasing you
Good luck!!
Good luck!! Re: Unlawful flight from police
I did some case study for you. IF they get the FE to stick, you're looking at a six month impound, and loosing your license for six months to one year with a max fine of $3,500. (http://www.ls1tech.com/forums/archiv...x.php/t-112780)
It's EXTREEMLY hard to get a felony evasion charge though because of a few things. #1 you can't hear the police a mile away, #2 if you didn't see them, and you were just speeding...you wern't really evading, just speeding. #3 a felonious activity would have sent you to jail right then and there when they knocked on your door, obvoiusly you didn't "think" they were chasing you or you wouldn't have opened the door. You're more likely to end up with a wreckless driving and speeding charge which will add points to your license and cost you some fines, but not a felony.
AZ statute: 28-1595. Failure to stop or provide driver license or evidence of identity; violation; classification
A. The operator of a motor vehicle who knowingly fails or refuses to bring the operator's motor vehicle to a stop after being given a visual or audible signal or instruction by a peace officer or duly authorized agent of a traffic enforcement agency is guilty of a class 2 misdemeanor.
Colorado (very similar to AZ) 42-4-1413. Eluding or attempting to elude a police officer.
Statute text
Any operator of a motor vehicle who the officer has reasonable grounds to believe has violated a state law or municipal ordinance, who has received a visual or audible signal such as a red light or a siren from a police officer driving a marked vehicle showing the same to be an official police, sheriff, or Colorado state patrol car directing the operator to bring the operator's vehicle to a stop, and who willfully increases his or her speed or extinguishes his or her lights in an attempt to elude such police officer, or willfully attempts in any other manner to elude the police officer, or does elude such police officer commits a class 2 misdemeanor traffic offense.
NC- Fail to Stop for Lights and Siren + 15 or more over posted Speed + one more violation.
Technically, yes they can charge you with a felony evasion, but all you have to repeat is that you DID NOT know that they were behind you. It gets pushed down to a misdomeaner and life is a little better. If you get even a half way decent lawyer, he or she should be able to realize that at one mile away, even after checking in your mirrors before turning, you wouldn't be able to clearly recognise a police car from any other car (if you could even see it at all) and that if you realized that the police officers were behind you that you would have made an effort to pull over since you're a law abiding citizen for the most part. If you have ANY speeding tickets, now would be a good time to bring those out too. Anything that might show that you've pulled over for a ticket in the past to show a history of not running.
Good luck and let us know what happens.
