what is the policemans jurisdiction in the lots??

first off, after searching the forums and sifting through pages of hits im only able to find posts about stories and nothing specific to my question, so here goes..

so im sure we've all heard about 30 ****ing stores from people who swear they know the law and what applies to what. now ive definitely had my share of streets tickets (32 points) so im not new to the police scene. i dont consider myself a smartass by any means and ive never had any problems with lots. when im told to leave, i leave. (only to return 30 minutes later right.. anyways).

and this should be a question for my lawyer, but what do cops legally have the right to do on public property when it comes to stunting?

aside from NOISE COMPLAINTS, TRESPASSING, and INJURY's, what gives a cop, by law, authority to remove you from the premise or write you a moving violation while on private property? assuming your bike is not hella loud to the point of a possible noise complaint, you have permissing to ride there or no tresspassing signs are visible, and no one has been hurt.

ive heard of poeple receiving reckless tickets and ive heard cops say they cannot cite moving violations on private property.

i guess my question is that if i stunt, say, in my own ****ing large driveway am i in danger of a reckless citation or something similar?

anyone care to enlighten me? thanks!

In most states they can give you wreckless and careless tickets anywhere. I heard about a guy in minneapolis who got a dwi for driving an electric wheelchair on the sidewalk drunk. Pigs can pretty much do what they want. It depends on the judge and lawyers as to whether the BS holds up.

whats up jseezy, you know the law here, they cant give a ticket unless there are signs posted, or the owners of the lot complains, but i have heard it is different in other states, so the best thing to do is contact someone there, like a lawyer, or maybe a police chief, and ask what the laws are, i have found out that if you at least ask someone that gives a sh*t, then you will get the right answer, dont ask some rookie cop cause all they will say is you cant do anything fun no matter what the laws atates, and if you do ask and they say ok, then get his badge number and let him know that if anything comes up, that he will be the first one you notify if you have to go to court for anything

in most MO cities, as long as the lot is not posted, or the owner has not written a letter to the city asking for police officers to enforce a no trespassing policy, you are free and clear. they cannot ask you to leave unless you are damaging the property. Cant write c and i's or wreckless etc etc... Best bet is to ask your lawyer, or go look up the city codes at city hall, that way when cops show up you can just break it off in their asses... cops **** but ignorant ones who act like they know **** are worse... worst case scenario, check the laws and let one freak out and arrest you then sue em... holla at bikes sponsored by johnny law..

i think for the most part cops can do what they want and write whatever ticket they want.. then its up to you and the judge to decide if its a valid reason for a ticket..
so a huge hassle reguardless if you get off or not..

In NY, Ive heard 2 different stories from cops.
1. they can write you for criminal infractions, but not traffic infractions on private property. Reckless is a criminal infraction.

2. If the lot is accessible to traffic (meaning not roped off) then the rules of the road apply, meaning they can write you for anything.

But realisticly, theyre cops, they can do whatever they want to you, maybe a judge will throw it out.

Cops can make up whatever bullshit they want and give you a ticket for it, most of them cant even get the laws straight between one cop to the next, they always tell me something different. you gotta take it to the judge and fight those lying *** traffic cops if you want to stand a chance.

That sounds true. In Youngstown they actually DUI'd a guy on a bicycle. It was funny listening to them tell stories about... bragging about it. They pretty much make it up as they go along. I feel sorry for people who can't afford lawyers.
