NEED HELP! Exhibition of speed in a parking lot???

So today i was at the spot practicing with a friend, but he had to go home only an hour into it. i decided to stay just a bit longer cause i didnt get that much practice time in yet. so about 15 minutes after he leaves, i set down an SS and a highway patrol is right on my ass. i dont think to run at all cause im on private property and a completely empty parking lot. i thought he was just gonna warn me and kick me out like usual, but instead he was a dick about it. He wrote me a ticket for exhibition of speed (misdemeanor). im like wtf... you cant just give me a warning and kick me out? he said no, im only writing you this ticket for your own safety....wow what an asshole. anyways, can he write me a ticket on private property?? can he even check my ID and reg and such?? if so, how can i fight it?? i live in california by the way.

In iowa the only two tickets they can write you on private property are OWI and reckless driving. No clue about cali tho

unless the lot is blocked off from public access they can do whatever they want as if its a normal road

since you did not have to lot closed off that sucks. I take barricades with me when I go. How did he figure it was exhibition of speed were you racing your buddy in a ss? Most parking lot speed limits are 25 mph.

im not sure how the law reads in cali , but in jersey its a 5 point ticket . its similar to engaging in a contest of speed , but since it was only you its not a contest , so exhibition would fit the bill so to speak . basically its saying you were flying around to show off . prob should have been a wreckless for doing a wheelie . either way id suggest at least consulting with an attorney....

Honestly, I don't know cali, but any judge here in NY would drop that shit to a parking ticket with a fine. I mean you could fight ALL of that if you don't want to pay a ticket. But I'd suggest, talk to the DA and at most, settle for the fine.

Re: NEED HELP! Exhibition of speed in a parking lot???

yea i dont care about the fine. i just dont want that stupid ass ticket on my record. i still have a clean record. but damn in NY, 5 points?!? thats excessive compared to us. wreckless and exhibition are worth two points and a misdemeanor.

Re: NEED HELP! Exhibition of speed in a parking lot???

a serious question, did you wheelie BECAUSE you saw the cop, or are you too blind to see a cop behind you before you wheelie?

If you did it because you saw the cop, well duh..

If you didn't see the cop.. well maybe the cop was in the right. You can't even see a COP CAR and your riding 'wrecklessly', what happens if a little kid came running into your stunt area how would you see them? (this IMO the cop could use as good reasoning..)

the facts are though, if you didn't own the property or have permission, you WERE trespassing.
If you didn't block off the road, pretty sure in all states, you can be ticketed for any traffic violation.
I mean, in cali, you can't go into a packed walmart parking lot and go 100mph can you?

okay, i never saw the cop car because at this spot, there are tall bushes and walls wrapped with bushes and little corners and turns where you can hide. Again, it was a parking lot in a business area with other buildings as well. The road is more like a thinner strip than a wide open space. Sure, i understand that a parking lot is a parking lot, whether its an empty business area or a liquor store at the corner street. I also understand that he can ticket me for 'wrecklessly' riding. But im just saying that in this case, its an empty parking lot with a vacant building. i just thought my ticket was too excessive thats why im asking for any suggestions as to how i can fight it or lower the penalty.

Re: NEED HELP! Exhibition of speed in a parking lot???

im from cali to and ive gotten out of a few tickets by getting extensions(2 or more at least) then by the time you have to go to court they usually misplace your stuff so there is no cop or representative for the cop there when you have to see the judge so the ticket gets thrown out>it worked for me

Here in florida, they tried to tickett sevral people for doing 45+mph in wall mart lot. ALL ticketts got thrown out(was on news local) Because #1 private property, not authorized to do so, #2 wall-mart has NO posted speed limit. Crazy, Also Here in fla, traffic cam ticketts are
" UNCONSTITUTIONAL" So they can only send us the pic, no tickette. same with toll booth running.(Crazy, but you stunt in a empty lot, it had better be closed from access by fence with closed gate Or they give you will full wantful wreckless, or the new one they love here, AKA stunt law, 1,500 for the first fine+court cost, an still have possibility they can confiscate your bike indefinite. so, Fuck our local law makers.(97% of cops here are rookies ass holes that love ticketting)
