Soldier trouble

this is kid of a rant--


I'm in Iraq right now and a friend of mine (fellow board member) is in some trouble.

He lives in a CHU. a container housing unit. it is a 10x10 room he shares with his wife. Basically he lives in the middle of a trailer, with another 10x10 room on either side

One day on his way back from the DFAC, he saw some lockers sitting outside his CHU, about 10 yards away from his door. The lockers were newer and nicer than the ones he had in his room. So, he swapped them.

About 3 months later, an MP comes knockin on his door. The MP asked him if he could come in and "look" around. He invites the MP in, with a local national in tow. The MP asks the "hajji" if that was the "stolen" property he was looking for. hajji says no and they leave. 10 min. later the MP comes back and asks my buddy to step out side. The MP tells my friend that he's being placed under arrest for vandalism and possession of stolen property. doesn't ask him his side of the story or anything, puts him in hand cuffs and takes him to the MP station.

After its all said and done my buddy pulls out his hand receipt and it says right there in black and white that he is signed for 2 wall lockers. no description, no serial numbers. Now this friend is looking at facing a summarized court marshal. OK, thats cool, go plead your case right? NO! He was informed today that for the proceedings of a summarized court martial the military will NOT provide him with an attorney. The maximum sentence here is like 30 days in jail. forfeiture of 2/3 a months pay for 2 months and reduction in rank to E-1.

Is it not absolutely crazy that a soldier can go to jail, in Iraq, with no attorney?

He was given the option of getting a civilian attorney. The cheapest quote he got was about 8k. so if hes found of no wrong doing, which he might be. cause he never vandalized anything, and its not like he was going to take the wall locker home with him. the property will stay in his CHU when he leaves. Then hes out 8k. all because some hajji pointed a finger at him.

Am I the only one that thinks this whole situation is fucked up?

see summaried court martial u cannot be represented by a miliary lawyer. only u can hire a civilan lawyer at now cost to the military. Also The military legal system is diff diltz see in military court yr guilty u have to proove your not to them as in civlian court its opposite

If he has to hire a lawyer and is found guilty he can file a law suit. Just to play hard ball back to em if he contacts a lawyer and starts by telling them that he plans to file a suit usually thats enough to get superiors involved and keep it out of court all together. It might b different overseas but thats what my lawyer advised me to do awhile back, but I was guilty as hell and still got off w 40hrs time served. That was just for bringing it up w a lawyer on the jail phone.
I donno thats just my thought from my experience but it may b something to consider. Hope it helps and good luck to ur friend. Nobody really wins once the courts get involved tho. U can only minimize loses. It sucks but its a business. Somebodies got to pay for theyr law school

It is a bunch of BS, but having just come back from Iraq, there is really nothing going on over there so the officers (of which i am one) have nothing better to do than go around looking for infractions. What is his Command doing to support him?
Most likely those lockers were just going to be put in another CHU, the mayors cell on what ever FOB he is on (typically staffed by TCNs) would have arrange to put new wall lockers in what ever CHU they were outside of. I don't see how it's stealing as there was no damage or destruction to them, just swapping them out.
He shouldn't make any statement, but if he is getting a summary court martial it is up to his command how to punish infractions. not the MPs.
I'd write to his congressman. seriously. commanders do not like congressional inqiries at all. and i'd get a lawyer if he wants to stay in. most likely he'll get reduced rank and lost pay, doubt he'll get confiment or jail. but it depends on the officer he goes before.

most unit SJA's work for the commander and the commander's interest and will not help the soldier, usually soldiers who are having article 15's or court marshalls imposed agianst them are sent to TDS. we had one SJA who helped the soldiers and that was ONLY for those who had FLIPLs assessed against them

The MPs can arrest people and charge them, however it is up to the unit command to decide on the punishment. Could the MPs have over looked it? sure, there are tons of locker and other furniture available for the CHUs but normally they have to pursue things especially if they are reported by the Mayors Cell.
